Charges for access to railway infrastructure

Most infrastructure managers for the 2023/2024 timetable will keep old price lists this year. Approvals for new draft new price lists have been requested by the Lower Silesian Road and Railway Service in Wrocław, the Pomeranian Metropolitan Railway and Sławków Euroterminal.

The following infrastructure managers: PKP PLK, Cargotor, PKP SKM in Tri-City, Betrans and PGE Energia Ciepła S.A. CHP Plant in Lublin Wrotków informed the President of the Office of Rail Transport that they will keep the price lists currently in force for the 2023/2024 timetable.

The President of the Office of Rail Transport currently checks the applications submitted by:

  • Pomorska Kolej Metropolitalna (Pomeranian Metropolitan Railway) – application for basic charge,
  • Dolnośląska Służba Dróg i Kolei we Wrocławiu (Lower Silesian Road and Railway Service in Wrocław) – application for basic charge,
  • Euroterminal Sławków – application for basic and shunting fee.

Companies recognised as managers of local railway infrastructure (not strategic infrastructure):  Jastrzębska Spółka Kolejowa sp. z o.o., Infra Silesia S.A., Kopalnia Piasku Kotlarnia – Linie Kolejowe sp. z o.o., Maczki-Bór S.A. and PMT Linie Kolejowe sp. z o.o. decided not to apply the provisions of the Railway Transport Act 2003 concerning the approval of price list specifying charges for access to railway infrastructure. Such action is permitted by Article 35a(1)(3) of the Railway Transport Act 2003.

An infrastructure manager may decide not to draft a new price list or a part of it, and apply for the next annual timetable an appropriate part of the price list in force in the previous annual timetable. In such case, an infrastructure manager informs the President of the Office of Rail Transport of their decision and updates their network statement accordingly (Article 33(22) of the Railway Transport Act 2003).

The President of the Office of Rail Transport approves the draft price list in the part concerning the method of determining the unit rate of basic and shunting charges within 90 days from the day of its receipt or refuses to approve it in case of its non-compliance with the regulations in force (Article 33(15) of the Railway Act 2003).

All decisions issued by the President of the Office of Rail Transport on access charges are be published in the Official Journal of the President of the Office of Rail Transport.
